Terms of Service
The terms that govern use of Open Gates, dennisgatesmusic.com, and related services.
Effective date: July 18, 2026
1. Agreement to These Terms
These Terms of Service (“Terms”) are an agreement between you and Dennis Gates (“Open Gates,” “we,” “us,” or “our”). They govern your access to and use of dennisgatesmusic.com, Open Gates software, downloads, resources, support, and related services (collectively, the “Services”). By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you use the Services for a church or other organization, you represent that you have authority to bind that organization.
2. Eligibility
You must be at least 18 years old or the age of legal majority where you live to create an account, make a purchase, or accept these Terms. The Services are intended for lawful church, ministry, business, educational, and personal use.
3. Accounts and Security
If an account is required, you must provide accurate information, keep your credentials confidential, and promptly notify us of suspected unauthorized use. You are responsible for activity under your account except to the extent caused by our failure to use reasonable security measures.
4. License to Use Open Gates
Subject to these Terms and any applicable order or subscription terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use Open Gates for your internal purposes. You may allow authorized members of your church or organization to use the Services within the limits of your plan. You may not sell, sublicense, rent, copy, modify, reverse engineer, defeat security or licensing controls, or create derivative products from the Services except where applicable law does not permit that restriction.
5. Acceptable Use
You may not use the Services to violate law or another person’s rights; upload malicious code; gain unauthorized access; interfere with security or operation; send spam; impersonate another person; scrape or harvest data without permission; or store or distribute content that is unlawful, infringing, defamatory, abusive, or harmful. You are responsible for confirming that you have permission to use and display lyrics, music, images, videos, fonts, Bible translations, and other content.
6. Your Content
You retain ownership of content you submit to the Services. You grant us a limited, worldwide license to host, copy, process, transmit, and display that content only as needed to operate, support, secure, and improve the Services. You represent that you have the rights needed to submit and use your content. We do not claim ownership of your church’s presentations, plans, lyrics, media, or other original materials.
7. Purchases, Subscriptions, and Taxes
Prices, billing periods, usage limits, and renewal terms will be shown at purchase or in a separate written order. Unless stated otherwise, subscriptions renew automatically until canceled. You authorize the applicable payment processor to charge your selected payment method. You are responsible for applicable taxes, except taxes based on our net income. Failure to pay may result in suspension or loss of paid features.
For the standard Open Gates subscription, monthly charges may be eligible for a refund when requested within 7 calendar days after the charge, and annual charges may be eligible for a refund when requested within 30 calendar days after the charge. Refund requests must be sent to dennisgatesmusic@gmail.com. Refund eligibility remains subject to exceptions required by applicable law and any additional terms disclosed at purchase.
8. Free, Trial, and Beta Features
We may offer free, trial, preview, or beta features. They may be changed or discontinued at any time and may be less reliable than generally available features. Unless we expressly state otherwise, beta features are provided without service-level commitments.
9. Third-Party Services
The Services may depend on or link to third-party products, websites, hosting, payment, email, media, or integration services. Your use of third-party services may be governed by separate terms. We are not responsible for third-party services or content.
10. Our Intellectual Property
The Services, software, site design, code, documentation, trademarks, logos, and materials we provide are owned by us or our licensors and are protected by intellectual-property laws. Except for the limited license in these Terms, no rights are granted to you. If you provide feedback, you grant us permission to use it without restriction or compensation, but we are not required to do so.
11. Service Changes, Suspension, and Termination
We may update, modify, suspend, or discontinue parts of the Services. We may suspend or terminate access if you materially breach these Terms, create security or legal risk, fail to pay, or misuse the Services. You may stop using the Services at any time. Provisions that by their nature should survive termination will survive, including ownership, disclaimers, liability limitations, and dispute terms.
12. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, COMPLETELY SECURE, OR COMPATIBLE WITH EVERY DEVICE, FORMAT, PLATFORM, OR THIRD-PARTY SERVICE.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION. OUR TOTAL LIABILITY ARISING FROM THE SERVICES WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US FOR THE SERVICES DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. THESE LIMITATIONS DO NOT APPLY WHERE PROHIBITED BY LAW.
14. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Dennis Gates and affiliated service providers from claims, damages, losses, and expenses arising from your unlawful use of the Services, your content, your violation of these Terms, or your violation of another person’s rights.
15. Governing Law and Disputes
These Terms are governed by the laws applicable where Dennis Gates principally operates, without regard to conflict-of-law rules. Any dispute that cannot be resolved informally will be brought in a court of competent jurisdiction. Before filing a claim, each party agrees to provide written notice and make a good-faith effort to resolve the matter for at least 30 days. Nothing in this section prevents either party from seeking urgent injunctive relief or using a qualifying small-claims process.
16. Changes to These Terms
We may update these Terms from time to time. The revised Terms will be posted with a new effective date. If a change materially affects your rights, we will provide additional notice when required. Continued use after the revised Terms take effect means you accept them.
17. General Terms
These Terms and any applicable order form are the entire agreement concerning the Services. If one provision is unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganization, financing, merger, acquisition, or sale of assets.
